Developers are responsible for taking out this compulsory insurance to deliver a building.
The LOE (Law 38/1999 of 5 November, on Building Regulations) obliges the Promoter to take out a Ten-Year Guarantee Policy that guarantees during the 10 years after the delivery of the property any damage that occurs in the insured building as long as it compromises the structure of the same and has its origin during the construction period.
In the case of self-promoters of single-family dwellings destined for their own use, this is not obligatory. However, the property cannot be registered in the Register and therefore cannot be sold in the first 10 years after its construction.
Basic Cover
- Material damage to the development, such as material damage caused to the development attached to the insured buildings, if the damage is a direct consequence of a loss covered by the policy.
- Debris removal expenses: dismantling and removal of the remains.
- Salvage expenses to reduce the effects of a loss covered by the policy.
- Permits and/or licences: costs of obtaining permits or compulsory licences to rebuild the damaged property.
